Terms & Conditions

These Terms and Conditions ("Agreement") govern the provision of services by Artima Solutions, the service provider offering training, administrative support and related services as described in this agreement. By accessing, using, registering, or making payments through our website or otherwise engaging with our services, you ("Candidate", "User") agree to be legally bound by this Agreement. Please read these Terms carefully, and tick the box to signify your acceptance before proceeding.

 

1. Definitions

 

1.1. "We", "Us", "Our", or "Company" refers to Artima Solutions.

1.2. "Candidate", "User", or "You" refers to any individual using our services for job placement, training, or other recruitment services.

1.3. "Training" or "Training Services" refers to the educational programs, courses, and associated training materials arranged by us, accredited by relevant bodies such as the Care Quality Commission (CQC) and may include but are not limited to health and safety, safeguarding, first aid, and other sector-specific training.

1.4. "Support Services", “Services” refers to supplementary services offered by the Company, including assistance with CV writing, interview preparation, mock interviews, and job application guidance.

1.6. "Non-refundable" refers to fees paid for our services that will not be returned under any circumstances, except where required by applicable law.

1.7. "Agreement" or "Terms and Conditions" refers to the contractual obligations, rights, and conditions set forth in this document, governing the relationship between the Company and the Candidate.

1.8. “Other agencies” refers to the staffing agencies or organisations that We may assist the Candidate in registering with upon successful completion of training.

 

2. Service Overview

 

2.1. Upon receiving the requisite payment, We will enrol the Candidate in training programs at designated venues within London and surrounding areas, subject to availability.

2.2. After successful completion of the training, We will assist with the registration process for employment opportunities with Other Agencies.

2.3. We will provide assistance with the preparation and revision of the Candidate's CV and support with job applications as part of our recruitment services, if required.

2.4. The fees charged cover training, administrative costs, and service-related expenses and are strictly non-refundable once payment is made and training delivered.

2.5. We reserve the right to decline or terminate service provision to any Candidate who has not completed the payment process in full.

 

3. Payment Terms

 

3.1. All fees must be paid in full before the commencement of services. We do not offer partial payments, payment plans, or deferred payment options unless explicitly agreed in writing.

3.2. Payments can be made via debit card, credit card, or other approved payment methods. Any delay in payment will result in a delay in the commencement of services, including the training registration.

3.3. Payments are strictly non-refundable, even if the Candidate does not complete the training, fails to pass the required examinations, or does not secure employment.

3.4. We are not responsible for the outcome of the training, including the Candidate’s ability to pass the training or to meet the employment requirements set by Other Agencies.

 

4. Training and Venue Information

 

4.1. All training sessions will be held at pre-approved venues in London and surrounding areas. It is the Candidate’s responsibility to attend the sessions as scheduled.

4.2. We do not guarantee that training venues will be within close proximity to the Candidate’s residence. Travel and accommodation costs are the responsibility of the Candidate.

4.3. If the Candidate fails to attend the scheduled training or withdraws partway through the program, no refunds or compensations will be made.

4.4. The Candidate acknowledges that training sessions may be subject to change, including rescheduling or venue changes, due to circumstances beyond our control. We will endeavour to provide notice of such changes as early as possible.

 

5. Liability

 

5.1. We are not liable for any damages, losses, or delays resulting from the Candidate's failure to attend training sessions, register for job opportunities, or comply with the requirements of Other Agencies or regulatory body.

5.2. We provide no guarantee that the Candidate will pass the training, receive certification, or secure employment through Other Agencies or entities.

5.3. Under no circumstances will we be liable for any consequential, incidental, or indirect damages resulting from the Candidate’s use of our services.

5.4. We are not responsible for any technical issues, including but not limited to system failures, payment gateway issues, or website outages, that may impede the registration or training process.

 

6. Certification and Employment

 

6.1. Upon successful completion of the training, the Candidate may receive CPD Certification as recognized by applicable bodies. However, we do not guarantee the acceptance of this certification by any third party, employer, or regulatory body.

6.2. Employment opportunities with Other Agencies are subject to their own selection processes, and we do not guarantee employment or any particular outcome.

6.3. We may assist the Candidate in submitting job applications, but we do not influence the final hiring decision made by Other Agencies or employer.

6.4. Other Agencies or employers may have their own additional requirements or stipulations, and it is the Candidate's responsibility to fulfil these requirements to be considered for employment.

 

7. Non-Transferable Rights

 

7.1. The Candidate’s registration and rights under this Agreement are strictly personal and non-transferable.

7.2. The Candidate is not permitted to sell, trade, or transfer any services or rights obtained through this Agreement to any third party.

7.3. Access to the services provided by the Company will be granted solely to the Candidate named in the Agreement.

 

8. Termination and Cancellation

 

8.1. We reserve the right to terminate this Agreement without prior notice if the Candidate is found to have engaged in fraudulent activity, provided false information, or violated any term of this Agreement.

8.2. In the event of termination due to the Candidate’s breach of this Agreement, no refunds will be issued.

8.3. If the Candidate chooses to withdraw from the services before completion of the training, no refunds or credits will be provided.

8.4. We reserve the right to cancel any training sessions or services at our discretion due to unforeseen circumstances. In such cases, we may reschedule the session or offer a credit for future services, but are under no obligation to provide a refund.

 

9. Confidentiality and Data Protection

 

9.1. We will process and store personal data provided by the Candidate in compliance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

9.2. By using our services, the Candidate consents to the collection, processing, and storage of their personal data for the purposes of training registration, job application support, and other related services.

9.3. We take reasonable measures to protect personal data; however, we are not liable for any unauthorised access or breach of security that is beyond our control.

 

10. Dispute Resolution

 

10.1. Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to this Agreement, both parties agree to first seek to resolve the matter informally through direct communication. Each party shall make a reasonable effort to discuss and resolve the issue amicably.

 

10.2. Waiver of Legal Proceedings: The Candidate agrees that, by entering into this Agreement, they waive the right to initiate any legal proceedings in a court of law against Artima Solutions for any disputes related to this Agreement, except as may be required by applicable law. This waiver does not prevent the parties from seeking resolution through negotiation or other informal means.

 

11. Governing Law and Jurisdiction

 

11.1. This Agreement is governed by and construed in accordance with the laws of England and Wales.

11.2. Any disputes or claims arising under or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. Amendments and Modifications

 

12.1. We reserve the right to amend or modify these Terms and Conditions at any time without prior notice.

12.2. Any amendments or modifications will be effective immediately upon posting to our website or communication to the Candidate. It is the Candidate’s responsibility to regularly review these Terms for any changes.

 

13. Fee Variability

 

13.1. The fees for services provided by [Your Agency Name] are subject to change based on market conditions, regulatory requirements, and the cost of service provision.

13.2. We reserve the right to adjust our fees at any time, and any changes will be communicated to the Candidate in writing prior to the next billing cycle or service engagement.

13.3. The Candidate acknowledges that fees may increase or decrease depending on the aforementioned factors, and agrees to pay the applicable fees in effect at the time of service registration.

13.4. Any changes to the fees will not affect the Candidate's current payment obligations for services already rendered or committed to prior to the adjustment.

 

 

14. Entire Agreement

 

14.1. This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements, discussions, or communications.

14.2. No third party shall have any rights to enforce any term of this Agreement under the Contracts (Rights of Third Parties) Act 1999.

 

By completing the payment process, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. Failure to abide by these terms may result in the termination of services without refund.
